Nursing Home Residents Have Rights
Under the Illinois Nursing Home Care Act, residents have the right to be treated with courtesy and respect and to have their human and civil rights maintained in their medical care.
Illinois law also specifically states that basic human needs—including water, food, medication, toileting, and personal hygiene—must be accommodated in a timely manner, consistent with the resident’s needs and care plan. Residents also have rights related to autonomy and participation in decisions about their care.
These protections matter when a resident:
- Experiences changes in health or behavior
- Has repeated falls or injuries
- Is waiting too long for assistance
- Has medication or treatment concerns
- Misses medical appointments
- Experiences changes in nutrition, hydration, mobility, or hygiene
- Has difficulty getting questions answered
- Is not being meaningfully included in care decisions
One isolated concern may have an explanation. A pattern deserves attention.
Medicaid Pays for Nursing Home Care—But Residents Still Deserve Quality Care
Many Illinois nursing home residents depend on Medicaid to help pay for long-term care.
Illinois Medicaid reimburses nursing facilities through a facility-specific daily per-diem payment. The rate includes nursing, support, and capital components. Illinois publishes current nursing-facility Medicaid rates, see links below.
Medicaid funding does not eliminate a resident’s rights.
A resident’s ability to pay for care should never mean their dignity, voice, safety, or healthcare needs are overlooked. Illinois law protects residents’ rights regardless of their status as a facility resident.

The Illinois Department of Public Health (IDPH) accepts complaints involving nursing homes and other regulated healthcare facilities.

Suspected Abuse, Neglect, or Exploitation
Illinois identifies several agencies that may receive reports involving suspected abuse, neglect, or exploitation in long-term care facilities, including the regional Ombudsman, Illinois Department of Public Health, and other appropriate state agencies. If a resident is in immediate danger, call 911.
Illinois law also prohibits certain retaliatory actions against residents who engage in protected activities, including raising concerns about conduct they reasonably believe violates a law, rule, or regulation.
